⚖️ As an NDIS participant, you have important rights protected by law. This guide explains what you're entitled to and how to act on those rights.
✅ Right to Choose Your Own Providers
You have the right to choose which providers deliver your NDIS supports. You can change providers at any time and are not locked in.
- Choose any registered provider for funded supports if you are NDIA-managed
- If you are self-managed or plan-managed, you can choose any provider including unregistered providers
- You can request to change providers at any time — you are not required to give lengthy notice unless your service agreement requires it
- No one can pressure you to stay with a provider
🗣️ Right to an Advocate or Support Person
You have the right to have someone with you at any meeting — including planning meetings, reviews, or provider discussions.
- Bring a family member, friend, carer, or paid advocate to any NDIS-related meeting
- Request an interpreter if English is not your first language — this is free through the NDIA
- Contact a disability advocacy service if you need independent support
- The NDIA must accommodate your communication needs

📋 Right to a Fair and Compliant Plan
Your NDIS plan must be developed in partnership with you and must fund supports that are reasonable and necessary for your disability.
- Participate fully in your planning meeting and have your goals heard
- Receive a plan that links your funded supports to your goals
- Have your cultural, religious, and linguistic identity respected in planning
- Request a review if you believe your plan is inadequate (see below)
- Have your plan explained to you in a way you understand
🔄 Right to Request a Plan Review
If you are unhappy with your NDIS plan or your circumstances have changed, you can request a review at any time.
- Request an unscheduled plan review if your needs have significantly changed
- Request an internal review if you disagree with an NDIA decision
- If the internal review outcome is still unsatisfactory, apply to the AAT (Administrative Appeals Tribunal)
- You have 3 months to request an internal review from the date of an NDIA decision
- You can have support from an advocate during this process

📣 Right to Make a Complaint
You have the right to complain about a provider or NDIS support without fear of losing your services.
- Complain directly to your provider first — they must have a complaints process
- Contact the NDIS Quality and Safeguards Commission if the issue is not resolved
- Make a complaint about poor quality supports, abuse, neglect, or misconduct
- Your services cannot be withdrawn or reduced because you made a complaint
- Anonymous complaints are accepted by the NDIS Commission

🔒 Right to Privacy and Confidentiality
Your personal information is protected by law. Providers and the NDIA can only use your information in limited, lawful ways.
- Your personal information is protected under the Privacy Act 1988 and the NDIS Act 2013
- Providers must have a privacy policy and handle your data lawfully
- You can request access to your personal information held by any provider or the NDIA
- Providers cannot share your information with third parties without your consent (except in limited lawful circumstances)
- The NDIA cannot share your plan details with your employer or family without your permission
🛡️ Right to Safety and Freedom from Abuse
Every NDIS participant has the absolute right to be safe and free from abuse, neglect, exploitation, and violence.
- Report concerns about abuse or neglect to the NDIS Commission immediately
- Providers must have safeguarding policies and conduct worker screening checks
- You can report unsafe incidents, restrictive practices, or worker misconduct
- Police can be contacted for immediate safety concerns — call 000
- The Disability Royal Commission (now completed) heard evidence and made recommendations for stronger safeguards
